The plight of undertrial prisoners languishing in jail for legal aid unsettled was highlighted by the Prime Minister Narendra Modi. The PM today called for legal aid to such prisoners to help secure their release. The Petitioner one Sandeep Kumar claimed that Private Respondents are running their recycling plants in a residential area without obtaining the requisite permission/consent of the State Pollution Control Board and the other authorities. Twin Tower demolition case: Supreme Court directs Supertech to pay Rs 70 lakh to CBRI

The Supreme Court has directed Supertech builders to immediately release Rs 70 lakh to the Central Building Research Institute (CBRI), which was roped in as a consultant in the structural audit of the company’s 32-storeyed twin towers — Apex and Ceyane, in Noida. A Bench comprising Justice Dhananjaya Y Chandrachud and Justice JB Pardiwala passed the order on Friday, after CBRI backed out from the meeting called by Noida authority on July 19, citing non-payment of its fees of Rs 70 lakh. The Court further gave demolition agency Edifice Engineering and Supertech time till August 5 to share all required data with regard to the safety audit, vibration report, test blast results, and clearing of debris. The Apex Court further told the Noida Authority to call a meeting of CBRI, Edifice Engineering and Supertech on August 6, in case of any difficulty. Central Government: CBI Director has no case pending complaint or court case against him

The Bombay High Court was apprised by the Central Government that the Director of Central Bureau of Investigation (CBI) Subodh Kumar Jaiswal has enough experience dealing with anti-corruption cases and has no pending complaint or court case against him. NGT directs Ludhiana Municipal Corporation to pay Rs 100 cr compensation for fire at garbage dump side

The Ludhiana Municipal Corporation has been directed by National Green Tribunal to deposit Rs 100 crore with the District Magistrate as interim compensation for the death of seven persons in a fire at a garbage dump site at Tajpur Road. Majority of the deceased belonged to a rag-picker family, who were living near the site for the last 10 years, with a huge dump of 20 lakh tonnes. Prima facie, there was failure of the state authorities in complying with the Solid Waste Management Rules, 2016, noted the Tribunal. NGT said the Monitoring Committee, the Municipal Corporation and other State Authorities failed to provide clean environment to people, besides failing to comply with the SWM Rules, not only at Ludhiana, but even at other places. Supreme Court upholds constitutional validity of PMLA

The Supreme Court today upheld the Constitutional validity of the Prevention of Money Laundering Act (PMLA). The judgment was pronounced by a bench of Justices AM Khanwilkar, Dinesh Maheshwari and CT Ravikumar on a batch of 241 petitions challenging the validity of the law. The validity of Sections 3 (definition of money laundering), 5 (attachment of property), 8(4) [taking possession of attached property), 17 (search and seizure), 18 (search of persons), 19 (powers of arrest), 24 (reverse burden of proof), 44 (offences triable by special court), 45 (offences being cognizable and non-bailable and twin conditions for grant of bail by court) were upheld by the court. ED files plea in Delhi High Court, seeks examination of Satyendar Jain in AIIMS

A petition was filed in the Delhi High Court by the Directorate of Enforcement (ED), challenging the trial court orders, permitting Delhi Minister Satyender Jain to be medically examined and admitted in Delhi government-run Lok Nayak Hospital. As per ED, Jain should be medically evaluated by an independent hospital like the All India Institute of Medical Sciences (AIIMS) or Ram Manohar Lohia because there was a likelihood of his medical report from a Delhi government hospital being tutored, since Jain is a Minister with the Delhi government. No coercive action on Narayan Rane’s Juhu bungalow: Bombay High Court

The Brihanmumbai Municipal Corporation (BMC) was directed by the Bombay High Court on Monday to abstain from taking any coercive action against the alleged unauthorised constructions of Union Minister Narayan Rane in his Juhu bungalow, till August 23. A bench comprising Justice R.D. Dhanuka and Justice Kamal Khata further told BMC to file an affidavit, regarding the maintainability of Rane’s application to retain the unauthorised portions of the structure. After his first plea was rejected by BMC, Rane filed another application. The Apex Court asked BMC about the maintainability of a second application on the same issue. The Court further sought to know from BMC, whether it will apply the Development Control and Promotion Regulation 2034 to the present structure, while deciding the application. The Bench said it will set a precedent for future. The petition was filed by Advocates Shardul Singh and Prerna Gandhi on behalf of Kaalkaa Real Estates, a company owned by Rane’s family.

Supreme Court orders to de-seal Azam Khan’s University

Setting aside the bail condition imposed by the Allahabad High Court to seal the premises of Mohammad Ali Jauhar University at Rampur while granting bail to Samajwadi Party leader Azam Khan, the Supreme Court on Friday directed the Joint Magistrate/Deputy District Magistrate, Rampur to take immediate steps to de-seal the same. The SP MLA, who is one of the members of the board of trustees of the varsity, sought directions to the Uttar Pradesh authorities to, inter alia, de-seal the portions of the premises of the Mohammed Ali Jauhar University, which were sealed on the orders of the Allahabad High Court. A Bench comprising Justice A.M. Khanwilkar and Justice J.B. Pardiwala, however, said that its order would not impact any proceeding for sealing, if initiated independent of the impugned order of the High Court. Supreme Court tells Centre to prepare chart regarding action taken to prevent hate speeches, such events

The Supreme Court has ordered the Union Home Ministry to prepare within six weeks, a chart regarding remedial, preventive and corrective measures  taken to address the issue of hate speeches. A Bench comprising Justice A.M. Khanwilkar, Justice A.S. Oka and Justice  J.B. Pardiwala on Thursday further directed the Ministry to mention in the chart, the compliance with general directions issued by the top court in the verdicts of Shakti Vahini and Tehseen Poonawalla. The Apex Court said that it will reactivate those cases, if they have not been complied with, across the country. In Poonawalla case, the Supreme Court had condemned the incidents of mob lynching/violence in the country and asked the Parliament to consider framing a special legislation to tackle the same.  The Court had also outlined measures to be put in place, including dedicated nodal officers and a special task force, immediate registration of complaints and free legal aid to victims of mob violence. Supreme Court permits unmarried woman to abort 24-week pregnancy

The Supreme Court permitted an unmarried woman to abort her 24-week foetus arising out of a live-in relationship, after a medical board constituted by AIIMS Delhi concluded that the pregnancy can be aborted without risk to the life of the woman. The Apex Court Bench, headed by Justice D.Y. Chandrachud and also comprising Justice Surya Kant, observed that the Delhi High Court took an ‘unduly restrictive’ view of the provisions of the Medical Termination of Pregnancy Rules, while declining the woman interim relief. After the 2021 amendment, the Medical Termination of Pregnancy Act uses the word ‘partner’ instead of ‘husband’ in the explanation to Section 3, noted the top court of the country, stating that this showed the legislative intent to cover an ‘unmarried woman’ under the Act. The Court observed that on this basis, the petitioner cannot be denied the benefit on the ground that she was unmarried.
