Manipur High Court stays all construction on land earmarked for park in National Games Village

The Manipur High Court has recently ordered status quo and all construction activity discontinued on the land earmarked for the National Games Village at Meitei Lango for building quarters. The Division Bench of Chief Justice Sanjay Kumar and Justice M.V. Muralidaran passed this order during the hearing of a PIL alleging that no relevant legal procedure has been followed for change of land use inasmuch as an area earmarked for a Public Park is now sought to be used for construction of quarters. From the record made available by the petitioners as well as P. Tamphamani, Junior Government Advocate, attached to the office of the Advocate General, Manipur, the Bench found that the subject land was shown as ‘Park A’ in the Layout Plan for National Games Village at Meitei Langol. Hate speeches: Jamiat Ulama-i-Hind files plea in Supreme Court, seeks Central report on action taken against hatemongers

The Jamiat Ulama-i-Hind (JUH) moved the Supreme Court on Friday demanding action against those making provocative anti-Muslim speeches across the country. The plea filed by the JUH and scholar and social activist Maulana Syed Mahmood Asad Madani sought the issuance of appropriate directions in relation to the alleged continuous attack on Prophet Mohammad and disparaging remarks by various persons in different parts of the country, attacking the very belief system of the Muslim community at large. Delhi High Court, district courts to go fully virtual for two weeks from January 3

Delhi High Court Chief Justice Justice D.N. Patel on Thursday directed that the High Court and Delhi district courts will take up matters through virtual mode only from January 3 as per the existing arrangement with regard to the listing of cases. Justice Patel said the aforesaid arrangement shall continue till January 15, 2022 when the entire situation shall be reassessed and reviewed. The Registrar and Joint Registrar (Judicial) shall also take up matters through virtual mode only, he said in a statement. In the backdrop of rising Covid-19 cases in the capital, he said: “It’s high time that this Court also takes all the possible precautionary and preventive measures to thwart any possibility of a resurgence of any wave of extreme nature.” Justice Patel observed: “The inputs have also been taken from the President of Delhi High Court Bar Association as well as from the Chairman of Coordination Committee of All District Court Bar Associations of Delhi and other senior office bearers

Allahabad HC dismisses PIL as infructuous

The Allahabad High Court recently dismissed a PIL, which had raised the grant of medical facilities to retired judges of the High Court, as infructuous. The  matter was registered as a PIL by the order of  the then Chief Justice dated December 22, 2010 on the basis of the report of  V.K. Shukla, J. Chairman, Medical Reimbursement Committee. On December 21, it was pointed out by Ajay Prakash Paul, State Law Officer, that in compliance of directions issued by the Supreme Court vide orders dated October 24, 2018 and April 30, 2019 in Contempt Petition (C) No. 425-426 of 2015, titled as Justice V.S. Dave, President, the Association of Retired Judges of Supreme Court and High Courts v. Kusumjit Sidhu and others, the State Government has issued Government Order dated September 24, 2019 granting same medical benefits to retired Chief Justices/Judges as are available to sitting Chief Justices/Judges of the High Court. Police in Manipur’s Senapati district averted an instance of mob lynching of a man accused of raping a minor on Sunday, December 26. Gauhati High Court disposes of PIL on road from Jamiri to Buragaon

The Gauhati High Court recently closed a PIL which was filed in relation to non-construction of the road from Jamiri  (Nagmandir, BRTF Road) to Buragaon (Full Stage). The division bench comprising of Justice N. Kotiswar Singh and Justice Malasri Nandi heard the PIL filed by Shri Ram Veo. Additional Senior Government Advocate, Arunachal Pradesh submitted on the basis of the instruction received from the Executive Engineer, Rural Works Department, Singhchung Division, West Kameng District, Arunachal Pradesh dated December 21, 2021 that the construction of the road from Jamiri (Nag Mandir BRFT road) to Buragaon (Full Stage) has been completed in all respects. The Madras High Court has recently ruled that the assembling of the law students in front of the Law College cannot constitute unlawful assembly while quashing all the criminal proceedings against law students who were denied permissions to celebrate the birthday of Dr. B.R. Centre extends AFSPA in Nagaland by 6 months

The Central government has extended the Armed Forces (Special Powers) Act (AFSPA) in the state of Nagaland for a period of another six months by a notification issued by the Ministry of Home Affairs dated December 30, 2021. The Central government is of the opinion that the use of armed security forces in aid of the civil power becomes necessary as the area which comprises of the state of  Nagaland is in a dangerous and disturbed condition, hence the extension is necessary. Centre notifies rules for consumer protection, direct selling entities not to promote pyramid schemes

The Central Government on Tuesday has notified the rules for Consumer Protection. The Ministry Of Consumer Affairs, Food and Public Distribution, Department of Consumer Affairs by exercising the powers conferred by clause (zg) of sub-section (2) of section 101 read with section 94 of the Consumer Protection Act, 2019, has made the Consumer Protection rules. The rules notified by the Centre to be called as Consumer Protection (Direct Selling) Rules, 2021. The Central government prohibited direct selling companies from promoting Pyramid Schemes. The notification also prohibits any person from enrolling into such a scheme in order to undertake direct selling business. The Consumer Protection (Direct Selling) Rules, 2021 further prohibits participation in money circulation schemes by such sellers and directs them to comply with the given rules within three months from the date of publication of the Consumer Protection (Direct Selling) Rules, 2021 in the Official Gazette i.e., December 28

Gauhati High Court issues notice on PIL against handling of solid waste disposal in Arunachal Pradesh

The Gauhati High Court recently (December 23), issued notice on a Public Interest Litigation (PIL), filed raising concern as regards the dismal handling of the solid waste disposal by the Government of Arunachal Pradesh and its instrumentality, more particularly in the Itanagar and Naharlagun area of the State. The PIL has been filed by one Takam Diring contending that notwithstanding the directives of the Ministry of Environment and Forest, Government of India and the provisions contained in the Solid Waste Management Rules, 2016, no steps have been taken by the respondent authorities for proper collection and disposal of the solid waste as a result of which, the citizens residing in this area are being exposed to serious inconvenience and health hazard. In support of the above contention, the petitioner has annexed copies of photographs which  demonstrate that there is practically no management of solid waste in various parts of the State. The Special Appeal has been filed to set aside the order dated September  28, 2021 (Om Prakash Gaur Vs. State of U.P. and others) and the transfer order dated July 15, 2021, passed by the respondent whereby the petitioner has been transferred from Shamli at a distance of about 900 kms. Covid-19: Yellow alert in Delhi under GRAP, night curfew from today from 10 pm to 5 am

Delhi Chief Minister Arvind Kejriwal on Tuesday announced the yellow alert under the Graded Response Action Plan (GRAP) with Covid-19 positivity rate going above 0.5 percent. Among the key restrictions are the night curfew coming into effect from today from 10 pm to 5 am, the shutting of all educational institutions, the capping of wedding and funeral gatherings to 20 people, reducing seat occupancy in the Delhi Metro and buses to 50 percent in the National Capital Territory of Delhi. As per GRAP, there shall be a night curfew on the movement of persons from 10:00 pm to 5:00 am throughout the NCT of Delhi. The Delhi Disaster Management Authority (DDMA) issued detailed orders related to the imposition of night curfew in the Capital. Allahabad HC acquits all convicts in Mathura triple murder case, flays shoddy probe

The Allahabad High Court has acquitted all the convicts in a Mathura triple murder case including one who had been awarded the death penalty. The Court expressed anguish with the “shoddy” manner in which the investigation was done. This was a case where there were three murders reported in a village in Mathura in the intervening night of June 18-19, 2018. Their bodies were found at three different places. Considering the appeals of the convicts, the Division Bench of Justice Manoj Mishra and Justice Sameer Jain held: “The prosecution evidence has failed to bring home the guilt against either Chandan Singh or any of the other accused put to trial in respect of the three murders. Hence, the charge of murder against the accused including Chandan Singh is held not proved and, therefore, the conviction of the appellants including Chandan Singh for the murder of Sundar Singh, Satya Prakash and Bhawar Singh is liable to be set aside.” The bench observed: “The Court is dealing with a ca

The Allahabad High Court has recently held that an employee cannot be deprived of his right due to delay in filling the option for gratuity a year before retirement. The division bench of Justice Surya Prakash Kesarwani and Justice Piyush Agrawal passed this order while hearing the petition filed by one Muharpal Singh. From bare perusal of Government orders, the court observed that the option for gratuity could be exercised by an Assistant Teacher a year before attaining the age of superannuation. In the present case, the petitioner was to retire on June 13, 2013 and he submitted the option on September 26, 2012 instead of submitting it by July 1, 2012. Thus, there has been a delay of about three months in submitting the option, the court observed. Delhi High Court allows appeal for medical reimbursement to retired Delhi govt employee

The Delhi High Court has allowed a petition seeking reimbursement of medical expenses filed by a retired Delhi Judicial Service officer in appeal against the claims rejection. The Court said the Delhi government could be a little more sensitive when it’s dealing with senior citizens who are their own retired employees who were seeking reimbursement of medical expenses. The petitioner herein is a Delhi Government Employees Health Scheme (DGEHS) member and a retired Judicial Officer of the Delhi Judicial Service. The single-judge bench of Justice Rekha Palli directed Delhi government to release Rs 4,27,276 (Rs 4.27 lakh) to the petitioner within two weeks, subject to verification of bills submitted by the petitioner as per procedure. The bench set aside the Delhi government’s order dated March 1, 2021 rejecting the reimbursement claimed by the petitioner. Delhi HC rejects suit against Waseem Rizvi’s book, plea said book makes provocative statements against the Prophet, Islam

The Delhi High Court has rejected a suit filed against the book written by Syed Waseem Rizvi titled Muhammad which is said to contain provocative and agitational statements with respect to Prophet Mohammed, Islam and the Quran. The suit was filed by Qamar Hasnain and sought damages worth Rs 2,05,00,000 to make Rizvi stop from committing such acts in the future. The single-judge bench of Justice Sanjeev Narula dismissed the suit which sought a permanent injunction to stop Waseem Rizvi from making such provocative statements or publishing them on any platform. The suit also sought permanent injunction to stop Waseem Rizvi from selling, circulating or distributing the book through any medium. It carried images of the recent 10th Standard Board exam that had carried an English comprehension passage which subscribed to the view that the man must be the head of the household—the lord and master—and the wife should be subservient, and she in turn could supervise the children and servants basking in his glory and frequently invoking fear of him. The breakdown of authority amongst teenagers had coincided with the emancipation of women…husband and wife argued now as equals and therefore the woman could not invoke fear as she herself had none anymore.  I for one began to think this post could never be true..it was just some concoction that someone on the social media machine had come up with….but then that was what I had thought when a WhatsApp message had gone around warning that from the following day our 500 and 1000 rupee notes would no longer be legal tender. The Allahabad High Court on Tuesday directed the Uttar Pradesh government to fill up the vacant senior level posts of doctors in all medical colleges of the state immediately. Also the Principal Secretary, Medical Education, Government of Uttar Pradesh, Lucknow is directed to personally oversee and make sincere efforts to see that not only at Meerut and Saharanpur but in all the other state medical colleges senior-level posts are timely advertised and vacancies are filled expeditiously as it directly affects the teaching of the students. CBI document leak case: Delhi court orders inquiry against Anil Deshmukh

Delhi’s Rouse Avenue court on Thursday ordered the CBI to conduct an inquiry against former Maharashtra Home Minister Anil Deshmukh in connection with the leak of CBI’s internal probe documents. The court said the agency seems to have released the main conspirator. The court said: “Despite clear evidence, the investigative agency has left the mastermind of the case and filed the charge sheet. Now, the CBI should investigate the involvement of Anil Deshmukh in this case and file its status report in 4 weeks.” The court said: “Further from the reading of the chargesheet as a whole, and the relevant record, it appears that accused persons Dilip Daga, Gajendra Tumane were closely associated with Anil Deshmukh and may have been acting in tandem with him, who may be the controlling mind of the larger conspiracy.” The hearing of the accused in the paper leak case will be held on January 10, however, Anil Deshmukh’s investigation report, in this case, will be heard on January 22. Chhattisgarh High Court dismisses PIL against encroachment on govt land in Rajnandgaon district

The Chhattisgarh High Court recently dismissed a PIL alleging that government land at village Aatariya, Tehsil Khairagarh, District Rajnandgaon which is recorded as grassland in the revenue record is being encroached upon by a private respondent. The PIL has been filed by one Har Prasad Verma. The counsel for the petitioner submitted that by manipulation of the document of revenue record, the encroachment is being made. He referred to a communication by the CEO, Zila Panchayat, Rajnandgaon dated 16/11/2021 and submitted that the khasra  over which a gothan (animal husbandry) was proposed to be constructed has been encroached upon, therefore it would lead to show that in land no open space is left.  The counsel for the petitioner further submitted that therefore inference has to be drawn that the encroachment has been made over the said land earmarked for gothan. The Supreme Court on December 15, during the hearing of an application from Kerala regarding release of water from the Mullaperiyar dam by Tamil Nadu without prior notice, observed that the Court could not be involved in the day-today administration of the dam and suggested that the concerned parties should consensually resolve their differences before the Supervisory Committee appointed by it. The Mullaperiyar dam is a masonry gravity dam on the Periyar river in Kerala. It is located in the Idukki district of Kerala. Although located in Kerala, the dam is operated and maintained by the neighbouring state of Tamil Nadu. The division bench, comprising Justices AM Khanwilkar and CT Ravikumar, deemed it appropriate that the parties must first approach the Committee before taking any steps to release or manage the water level of the dam.
