And the person living in such a relationship with a woman will be considered a criminal under Section 494/495 of the IPC. In a recent judgment, the Allahabad High Court ruled that a married woman moving in with another man without divorcing her spouse cannot claim to be in a live-in relationship and seek legal sanctity later. Petitioners Asha Devi and Suraj Kumar approached the High Court contending that they were both adults “living as husband and wife”, and so, no one should interfere in their lives. The petition was opposed by the state counsel on the ground that Devi started living with Kumar even as she was legally married to his client, Mahesh Chandra. The Madhya Pradesh High Court, in an important order on Friday clarified that Pollution Under Control Certificate (PUCC) centre is mandatory in every petrol pump in the state in order to keep pollution levels under control. Therefore, the order by the state government to make PUCC centre mandatory in all fuel stations i.e. petrol-diesel and gas pumps is correct. The Court held that this arrangement has been given with the intention of reducing the level of pollution due to pollution emitted from millions of vehicles. In such a situation, its opposition is unfair. On Thursday, the case was heard before the Division bench of Chief Justice Mohammad Rafique and Justice Vijay Kumar Shukla. By Col R Hariharan The New Year eve announcement of the Indian Army appointing Major General Gautam Chauhan as Additional Director General (Human Rights) formally recognises the importance of human rights in military operations. This is in keeping with the global trend of increased human rights awareness, particularly in unconventional and low intensity conflicts. General Chauhan will head the Additional Directorate General for Human Rights under the Vice-Chief of Army Staff (VCOAS) responsible for planning and execution of operations. He will be assisted by an officer of SSP/SP rank from the Indian Police Service on deputation. Details of the Directorate’s structure, responsibilities and functions are not yet available. The creation of an exclusive body under the VCOAS for dealing with human rights issues has not come a day too soon.
