Allahabad High Court grants anticipatory bail to advocate Arpit Bisht in assault case on policemen

The Allahabad High Court has granted anticipatory bail to Advocate Arpit Bisht who was allegedly involved in a case of assault upon a policeman with 5-6 other persons and snatching of his gun while he went for investigation of a case in ICICI Bank, Sector-18 Noida. 

The Court has sought the response of government and directed it to file counter affidavit within three weeks. The Court put up this matter for hearing on 21/01/2021, and directed to release petitioner on interim anticipatory bail till then in the event of his arrest. 

A single bench of Justice Siddharth passed this order while hearing the Anticipatory bail Application filed by Advocate Arpit Bisht.

In case of his arrest, the Applicant, Arpit Bisht, shall be enlarged on interim anticipatory bail in Case under Section- 395 I.P.C., Police Station- Noida Sector-20, District- Gautam Budh Nagar. on his furnishing personal bond of Rs. 50,000/- and two sureties each of like amount before the Station House Officer of Police Station/Court concerned with the following conditions:-

(i) The Applicant shall make himself available for interrogation by the Police officer as and when required.

(ii) The Applicant shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade from disclosing such facts to the Court or to any Police office.

(iii) The Applicant shall not leave India without the previous permission of the Court and if he has passport, the same shall be deposited by him before the S.S.P./S.P. concerned.

Counsel for the Applicant has submitted that the Applicant was not named in the FIR. He is a practicing Advocate enrolled at Delhi Bar Council. He went to the spot only on receiving the phone call of one Sarthak Tyagi, who is his friend and after the situation got out of control he left the place in a car with his friend. He had no role in the incident and has been falsely implicated in this case.

The Applicant has no criminal history to his credit. He has definite apprehension that he may be arrested by the Police at any time. His house was raided earlier. The applicant has been arrested by the police at 2:00 a.m last night. However, he has not been produced before the Court. The Court has given relief on this. Attachments area
