Allahabad High Court seeks information on technology-based system from UP govt counsel

The Allahabad High Court on Tuesday has sought information from the chief standing counsel of the Uttar Pradesh government as to whether the technology-based system stated to be established in the State Law Office, Allahabad and Lucknow, has been completed and sufficient number of staff has been posted. A week’s time has been given to submit this information.

The division bench of Justice S.P. Kesharwani and Justice R.N. Tilhari passed this order while hearing a petition filed by Kunwar Raj Singh and 2 others.

The grievance of the petitioners is that they are owners of the disputed land but the District Magistrate presuming the land in question to be Gram Sabha land, has resumed it illegally and without authority of law, passed the impugned order dated November 7, 2019 and the consequential order dated November 14, 2019 has been passed by the Tehsildar, Iglas, Aligarh.

The representation of the petitioners dated January 4, 2020 is not being considered at all by the respondents-authorities.

The notice of the Writ Petition was served upon the State- respondents on December 2, 2020 and thus, more than one and a half months have passed and yet the Standing Counsel could not get instructions.

In First Appeal of 1988, the Single Judge has passed some orders and pursuant thereto a statement was made on behalf of the State Government to establish a technology-based system in State Law Office for immediate communication/ information of the Writ Petitions to the concerned authorities and to obtain instructions from them with copies of supported documents.

However, it appears that the things have not been completed so far.

The chief standing counsel prayed for and was granted a week’s time to obtain instructions in the matter. The petition will be heard on March 8.
