Gauhati High Court closes a PIL pertaining to restrictions placed on non-vaccinated people in Assam

The Gauhati High Court recently closed off a Public Interest Litigation (PIL) filed pertaining  to certain restrictions placed on non-vaccinated people in the State of Assam.

The PIL has been filed by Jyotimoy Kalita and others.

It has been submitted by D. Upamanyu ,  Standing Counsel, Health Department that as of now, there are no such restrictions put in place relating to Covid in the State of Assam. However, as and when the situation demands, the authorities will promulgate necessary protocol.

While considering the PIL , the Division  Bench of Chief Justice (Acting) N. Kotiswar Singh and Justice Soumitra Saikia is of the view that because of the improved Covid situation, the matter may not be of much public importance at this stage, though certain issue of great importance of individual freedom is involved.

Under the circumstances, the Court is of the view that though the issue raised is of paramount importance relating to individual rights and liberties, the matter may be reagitated by the petitioners as and when any Covid restriction is put in place by the authorities.

“Accordingly, we close this PIL with liberty to the petitioners to approach this Court again as and when situation so warrants”, the order reads.
