Central Government appoints 9 additional judges of Madras High Court as permanent judges

The Madras High Court on April 1, 2022  had the sanctioned strength of 75 judges,of which 60 judges were working and 15 vacancies   The Central Government has thus notified the appointment of nine additional judges of Madras High Court as permanent judges of that Court. Uttarakhand High Court disposes PIL alleging unscrupulous diversion of irrigation channel

The Uttarakhand High Court disposed of a Public Interest Litigation filed alleging that certain unscrupulous persons have encroached and diverted the irrigation channel, due to which petitioner is unable to irrigate his agricultural land. The Petitioner is a resident of Village Bhawanpur Talla, Haldwani, District Nainital. Attack on Arvind Kejriwal’s official residence: Delhi HC asks Delhi Police to share report with Delhi CM’s secretariat

The Delhi High Court on Monday directed the Delhi Police to share the status report on the investigation into the alleged attack and vandalization at Delhi Chief Minister Arvind Kejriwal’s residence with the CM’s Secretariat. The Division Bench of Acting Chief Justice Vipin Sanghi and Justice Sachin Datta is seized of a plea filed by a member of the Aam Aadmi Party in the capital seeking an SIT probe into the vandalism at the official residence of the CM on March 30. During the hearing today, the Delhi Police handed over to the Court its status report in a sealed cover disclosing the steps taken to beef up security arrangements outside CM’s residence, including the decision to curtail protests near the Civil Lines Metro Station. Allahabad High Court stays recovery action against shopkeepers for spoiling of maize

The Allahabad High Court has put a stay on the recovery action being taken by the state government from the shopkeepers for the spoilage of thousands of tonnes of maize kept in the government shops. A Single Bench of Justice Saumitra Dayal Singh passed this order while hearing a petition filed by Anil Kumar Tiwari. The Court noted that, Submission of the counsel for the petitioner is, it is established from the impugned communication dated 25.1.2022 itself that the petitioner had not indulged in any malpractice or sale of essential commodity, here maize, except in accordance with law. Therefore, no demand could be made from the petitioner for admitted loss of value suffered by the surplus/unsold stock of maize that remained available to the petitioner because the beneficiaries did not lift the same. Gyanvapi Mosque: Varanasi fast track court hears petition regarding entry of Muslims

A fast-track court of Varanasi will be hearing the two fresh petitions on Monday, which were transferred to the fast track court seeking a ban on the entry of Muslims in the Gyanvapi mosque area. The petition was filed by Advocate Ashwini Kumar Upadhyay through advocate Ashwani Kumar Dubey which states that the property belongs to the official deity and no amount of namaz or illegal possession can take its place. The petition, filed by the Vishwa Vedic Sanatan Sangh, was taken up by Civil Judge Ravi Kumar Diwakar, who had also heard the Gyanvapi mosque case before it was transferred to District Judge Ajay Kumar Vishevesh by the Supreme Court on Friday after understanding the complexity of the issue. Gauhati High Court directs to go ahead with construction of road from Kigwema to Nagaland

The Gauhati High court recently directed all concerned authorities to go ahead with the construction of the road from Kigwema to the Border of Nagaland on the existing road and continue with the expansion after the RoW (Right Of Way) issue is resolved. The Kohima Bench of Justice Songkhupchung Serto and Justice Kakheto Sema heard a Suo Moto Public Interest Litigation (PIL) on the issue of incompletion of the National Highway 02 between Dimapur and Imphal. In the report submitted by A. Zhimomi, the  Amicus Curiae it is stated as follows: ”1. The contract has been split into two parts. The first part is the overlay section from Lerie to Kigwema and the reconstruction section is from Kigwema to Mao.  2. The overlay section is yet to be fully completed. Rajasthan High Court disposes PIL assailing the construction of Vikas Path through the agriculture land

The Rajasthan High Court on Thursday, disposed of a Public Interest Litigation (PIL) filed assailing the action of the respondents in constructing the Vikas Path (Road) through the agriculture land of the village Tinwari. The PIL has been filed by one Vijay Kumar Goyal. Kuldeep Mathur, the senior Counsel submitted  that as per the proposal dated 3.10.2019, the Vikas Path (Road) was required to be constructed on land entered as ‘Abadi’ in the revenue record and thus, the respondents have flouted the said order by constructing the road on agricultural khasras. To this submission, the Additional Advocate General  K.S.Rajpurohit, submitted  that it was consciously decided on 3.10.2019, that the road shall be constructed in the area which has been inhabited by population and not on land which has been designated to be Abadi land in the revenue record. Chhattisgarh High Court dismisses petition challenging notice regarding no confidence motion

The Chhattisgarh High Court recently on Monday, dismissed a Petition that challenged a notice dated 10.5.2022 issued by the Collector, Bemetara (CG) regarding no confidence motion. The Petition has been filed by President Nagar Panchayat of Bemetara District. The counsel for the petitioner submitted  that the impugned notice is arbitrary, illegal and contrary to law. The notice does not mention the names of the persons against whom, no confidence motion has been passed and the Collector has not made any enquiry before fixation of the date of no confidence motion, therefore, the impugned notice is unconstitutional. Places of Worship Act 1991: Yet another PIL filed in Supreme Court against law

A Public Interest Litigation has been filed in the Supreme Court seeking a declaration that Section 2, 3, 4 of the Places of Worship (Special Provisions) Act, 1991 is void and unconstitutional for being violative of Articles 14, 15, 21, 25, 26, 29 of the Constitution, in so far as it legalizes ‘the ancient historical and puranic places of worship and pilgrimage’, illegally occupied by barbaric foreign invaders. Chief Justice of India N.V. Ramana on Monday sought advice from fellow Supreme Court Judge, Justice J.K. Maheshwari, regarding the elevation of two Judges from one High Court to another. Usually the Supreme Court Collegium, headed by the Chief Justice of India and mostly comprising four other senior-most Judges of the Apex Court, which recommend the elevation of judges. Application filed in Supreme Court seeks impleadment in Gyanvapi Mosque dispute case

An application has been filed in the Supreme Court, seeking impleadment for appropriate appreciation of the facts-circumstances in the case related to Gyanvapi mosque dispute. The application has been filed by BJP leader and lawyer Ashwini Kumar Upadhyay, who had earlier filed a public interest litigation before the Apex Court, challenging the Constitutional validity of the Places of Worship (Special Provisions) Act, 1991. The Places of Worship (Special Provisions) Act, 1991 seeks to protect the status of all religious structures, as it stood on the date of independence by barring courts from entertaining cases, which raises dispute over the character of such places of worship. As per the law, such cases already pending in courts would stand abated. However, the Act provided exception for Ram-Janambhoomi site, which was the basis for courts, including the matter pending before both the High Court and the Supreme Court. Varanasi District Judge: Hearing in Gyanvapi case to begin today

The hearing in the Gyanvapi case begins today under the District and Sessions Judge of Varanasi, Justice Ajaya Krishna Vishvesha. The case involves the claim by the Hindu devotees who have filed a civil suit for getting the Right to worship inside the premises of Gyanvapi Mosque claiming it was a Hindu temple earlier and still has Hindu deities. On Friday ,Supreme Court bench of Justice D.Y Chandrachud, Justice Surya Kant and Justice PS Narasimha  had passed an order  to  transfer civil suit in Gyanvapi mosque case from the court of Civil Judge (Senior Division) to Varanasi District Judge. The Apex court had instructed that suit should be given the priority before any other matter. Supreme Court designates Senior advocate positions to former High Court Judges

In a full court meeting held on May 20, the Supreme Court of India has conferred the position of Senior Advocate to the retired High Court judges The names of the Justices who have been offered the position of senior advocates are: Govind Mathudesir Ravi K Deshpande  Dama Seshadri Naidu Vineet Kothari and ZA Haq among others. The decision was taken by the apex court at a full court meeting which was held this Friday,under section 16(2) of the Advocates Act 1961, read with rule  2(a) of order IV, Supreme Court. The position of senior advocates was offered to: Justice Govind Mathu r who served as judge of Rajasthan High Court and as Chief Justice of Allahabad High Court. Justice Ravi K Deshpande  who served as judge of the Bombay High Court where he served for 11 years before demitting office in November 2020. Justice ZA Haq  who served as Judge of Bombay High Court from 2013 to 2021. Justice Dama Seshadri Naidu  who belongs to Andhra Pradesh (AP) and was elevated as judge

Gauhati High Court closes a PIL pertaining to restrictions placed on non-vaccinated people in Assam

The Gauhati High Court recently closed off a Public Interest Litigation (PIL) filed pertaining  to certain restrictions placed on non-vaccinated people in the State of Assam. The PIL has been filed by Jyotimoy Kalita and others. It has been submitted by D. Upamanyu ,  Standing Counsel, Health Department that as of now, there are no such restrictions put in place relating to Covid in the State of Assam. However, as and when the situation demands, the authorities will promulgate necessary protocol. While considering the PIL , the Division  Bench of Chief Justice (Acting) N. Kotiswar Singh and Justice Soumitra Saikia is of the view that because of the improved Covid situation, the matter may not be of much public importance at this stage, though certain issue of great importance of individual freedom is involved. Supreme Court Issues Notice In Plea Challenging Changed Examination Pattern

The Supreme Court on Friday had issued notice in the writ petition that challenged the changed examination pattern in the NEET SS 2022, which would now consist of 150 questions from the general category of the primary feeder broad specialty subject and from all sub- specialty/systems/component of that primary feeder broad specialty subject. The writ was preferred by MD Radiation Oncologists and MD Anaesthesiologists NEET SS 2022 aspirant  who had challenged the changed examination pattern. What was also making the aspirants aggrieved was the draft Postgraduate Medical Education Regulations, 2021 published by National Medical Commission which had proposed deletion of  MD radiation oncology/radiotherapy as an eligible feeder specialty qualification for the super specialty course of DM Medical Oncology The petition was listed before the bench of Justices DY Chandrachud and PS Narasimha.
